On March 13, 2024, the Administrative Division 4 of the Seoul Administrative Court (Presiding Judge Kim Jeong Joong) issued a decision to dismiss and deny, respectively, an application for an enforcement injunction filed by the YTN branch of the National Media Workers' Union (the “YTN Branch”) and the YTN Employee Stock Ownership Association (the “Association”) against the Korea Communications Commission (the “KCC”) to suspend the effectiveness of the approval of the change in the majority shareholder of YTN.
At the hearing, representatives from the KCC pointed out the “lack of standing” of the YTN labor union and the ambiguity regarding the irreparable harm claimed by the Association. They argued that since the YTN labor union and the Association could sufficiently achieve their objectives through the action for annulment (main lawsuit), the requirements for granting injunctive relief are not met. In this lawsuit, large law firms such as Lin, Bae, Kim & Lee, and Yoon & Yang represented the KCC.
The court ruled against the YTN Branch, stating that the application itself was inadequate as the interests infringed by the KCC's decision could not be identified, and dismissed the application of the Association on the grounds that irreparable damage or urgent need for suspension of the approval could not be recognized.
