LIN's Entertainment & Sports Team, including attorney Jong Hyun KONG, successfully represented former members of the girl group "LOONA" - Hee-jin Jeon, Jeong-eun Kim, Jin-sol Jung, and Ye-rim Choi (also known as Hee-jin, Kim Lip, Jin-sol, and Choi Ri) in a lawsuit against their former agency, Blockberry Creative, seeking to invalidate their exclusive contract.
On June 20, the 11th Civil Division (B) of the Seoul Northern District Court ruled in favor of the plaintiffs in a civil lawsuit for confirmation of the invalidity of the exclusive contract filed by four individuals, Hee-jin Jeon, Jeong-eun Kim, Jin-sol Jung, and Ye-rim Choi, against Blockberry.
LIN's Entertainment & Sports Team won a favorable decision in the case seeking a preliminary injunction to suspend the effectiveness of an exclusive contract on behalf of the above artists in 2023. As a result of this decision, the above artists have been able to freely engage in entertainment activities without interference from their existing agency until the judgment in the main lawsuit is handed down, and they have formed a new girl group, ARTMS. As a follow-up procedure, our Entertainment & Sports Team obtained a victory in the main lawsuit of the above artists, which confirms that the exclusive contract between the artists and their existing agency is invalid.
The entertainment industry is growing rapidly and establishing itself, but behind the scenes, disputes between agencies and artists, the two main players in the industry, are also occurring frequently. It is common for an artist and agency to have an 'exclusive contract dispute' because the exclusive contract fails to bridge the gap between the agency's position, which has invested a lot of money in training trainees and debuting them, and the artist's position, which is to receive fair payment for their entertainment activities. Since artists and agencies may suffer tangible and intangible damages such as image deterioration simply by being in a state of dispute over exclusive contracts, it is necessary to obtain legal advice to prevent a dispute in advance and prepare a reasonable contract that takes into account the positions of both parties, and since the outcome may have a significant impact on the parties' entertainment activities, when a dispute does arise, it is necessary to identify the specific nature of the exclusive contract at issue and actively respond to the dispute.
LIN's Entertainment & Sports team has extensive experience in handling exclusive contract disputes between artists and agencies, and we are doing our best to secure the rights of artists by carefully analyzing the contents of the contract.
